Fed High Court has declined jurisdiction to hear PDP suit on the conduct of LG Council’s election in Niger state.

The Federal High Court sitting in Minna,Niger state has declined jurisdiction to hear and determine matters on local government election.
Justice Aminu Garba of the Federal High Court Minna after careful perusal of the Counsel written addresses to the Court on whether or not it has the jurisdiction to hear and determine the Plaintiff PDP’s case, held that for the Court to assume jurisdiction the principal reliefs must be directed to the first defendant INEC which is a Federal Government Agency.
Justice Garba further held in his ruling that the plaintiff PDP’s case can stand and survive without the first defendant INEC but can not stand without the second defendant, Niger State Independent Electoral Commission, as such the case is entirely within the affairs of the State law.
Justice Aminu Garba then declined jurisdiction to hear and determine the plaintiff that is PDP’s suit and ordered its transfer to the State High Court.
Recalled that the People’s Democratic party PDP had earlier filled a case at the Federal High Court Minna challenging the conducts of the scheduled November ten(10) 2022 Council’s election for alleged violation of provision of the constitution and the electoral act.
The Niger state Local Government Elections in dispute are scheduled to hold on the 10 / November/ 2022.
